NCLT Insolvency Actually Matlab Kya Hai?
Jab koi creditor (bank, homebuyer group, ya operational creditor) proof karta hai ki company default kar rahi hai, NCLT company ko IBC (Insolvency and Bankruptcy Code) ke under admit kar sakta hai. Iske baad company ka board suspend ho jaata hai aur ek Resolution Professional (RP) charge sambhalta hai.
Homebuyer Ke Liye Iska Matlab
- Aap "financial creditor" maane jaate hain — IBC 2018 amendment ke baad, homebuyers ko banks jaisa hi status mila hai.
- Claim file karna padta hai — RP ek public notice deta hai; usme diye gaye timeline ke andar apna claim (payment proof ke saath) file karna zaroori hai.
- Construction ruk sakta hai — moratorium period mein naya construction funding milna mushkil hota hai jab tak resolution plan approve na ho.
- Resolution plan hi final decide karta hai — koi naya buyer/developer project le sakta hai (jaise SWAMIH fund cases mein hua), ya liquidation bhi ho sakta hai.
⚠️ Critical: Agar aap possession se pehle hi red flags dekh lo — jaise builder ki parent company kisi aur project mein pehle se NCLT mein hai — toh booking se pehle hi bachne ka chance milta hai.

- Builder + parent group ka naam eCourts aur NCLT records mein check karein
- Sirf project-level nahi, group-level litigation dekhein
- Under-construction project mein especially developer credibility (past delivery, directors ka track record) verify karein — case history abhi ho hi nahi sakti naye project ke liye
